This Agreement is entered into between the undersigned dog owner (“Owner”) and Friends of the Cuyahoga County Animal Shelter (“FCCAS”), an Ohio nonprofit organization, together with its officers, directors, employees, agents, volunteers, veterinarians, representatives, and affiliates (collectively referred to as “Released Parties”).

1. Service. Owner certifies that they are the sole owner of the dog described above and also have full rights to authorize medical decisions for that dog. Owner acknowledges that they have voluntarily requested and consented to have their dog undergo spay or neuter surgery (the “service”). The service will be performed by a licensed veterinarian. Owner understands that FCCAS does not control or supervise the veterinarian providing the service and is merely funding the service. Owner understands that the service is a limited procedure solely for the purpose of surgical sterilization. The veterinarian will not provide comprehensive care or diagnostic testing as part of the service. Owner acknowledges that a full-service veterinarian may provide additional or more comprehensive care or diagnostic testing and has chosen to proceed with the service. Owner further understands that FCCAS may choose to terminate the service at any time for any reason.

2. Financial Responsibility. FCCAS is only providing the service to Owner. Therefore, Owner assumes full financial responsibility for all veterinary expenses, medical care, or damages incurred pre-service or resulting from the service or post-surgical complications. FCCAS and the Released Parties shall bear no responsibility for such expenses.

3. Post-Surgical Care. Owner agrees to follow all post-service instructions provided by the veterinarian. FCCAS and the Released Parties are not responsible for complications, injury, or death resulting from Owner’s failure to comply with these instructions. It is Owner’s responsibility to consult with a veterinarian of their choice and at Owner’s sole expense to ensure that the dog heals properly after the service so as to prevent infection or other injury to the animal.

4. Voluntary Participation and Assumption of Risk. Owner understands that anesthesia and surgical procedures involve inherent risks, including but not limited to infection, hemorrhage, adverse drug reaction, anesthetic complications, or death. Owner understands that animals may carry or be exposed to illnesses that are not immediately apparent. Owner voluntarily assumes all risks associated with the service. Owner hereby fully and forever waives, releases, and discharges FCCAS and all Released Parties from any and all claims, demands, damages, causes of action, or liabilities of any kind, whether known or unknown, arising out of or related to the service, any act or omission of a veterinarian, technician, or FCCAS representative, and any loss, injury, illness, or death of the dog, to Owner, and/or to third parties. This waiver includes, but is not limited to, claims arising from ordinary negligence of any Released Party, to the fullest extent permitted by Ohio law. Owner agrees to indemnify, defend, and hold harmless FCCAS and all Released Parties from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or related to the dog, the service, or Owner’s acts or omissions. Owner shall be responsible for all attorney’s fees and costs arising from Owner’s breach of this Agreement.

5. General. This Agreement shall be binding upon Owner and their heirs, executors, administrators, and assigns. This Agreement shall be governed by and construed under the laws of the State of Ohio. Any dispute shall be brought in a court of competent jurisdiction in Cuyahoga County, Ohio. This document constitutes the entire agreement between the parties. If any provision is held invalid, the remaining provisions shall remain in full force and effect.

THE UNDERSIGNED HAS READ, UNDERSTANDS, AND VOLUNTARILY AGREES WITH THE ABOVE TERMS.
